A guest purchaser can refer or recommend our product or service or website, will have the right to get money, based on companies promotion strategy. Trimmings of product and its use and promotion may have applicable, if necessary. All disputes or differences pertain here to or raisin here shall be adjudicated upon by a court of appropriate jurisdiction of the company. Customer will be responsible for any notes, messages, emails, reviews, ratings, billboard postings, photos, drawings, profiles, opinions, ideas, images, videos, audio files or other materials or information posted or transmitted to the Platform. Such Content will become our property and you grant us the worldwide, perpetual and transferable rights in such Content. We shall be entitled to, consistent with Our Privacy Policy as adopted in accordance with applicable law, use the Content or any of its elements for any type of use forever, including but not limited to promotional and advertising purposes and in any media whether now known or hereafter devised, including the creation of derivative works that may include the Content You provide. You agree that any Content You post may be used by us, consistent with Our Privacy Policy and Rules of Conduct on Site as mentioned herein, and you are not entitled to any payment or other compensation for such use.

Payment:

Use of payment methods available on the Platform, will not be responsible any liability, in respect of any loss or damage arising directly or indirectly of your payment. All payment calculations will be in Indian Rupees acceptable in the Republic of India. Transaction, Price and all commercial terms such as Delivery, Dispatch of products or services are as per principal to principal bipartite contractual obligations between Buyer and Seller and payment facility is merely used by the Buyer and Seller to facilitate the completion of the Transaction. Use of the payment facility shall not render Biandso’ liable or responsible for the non-delivery, non-receipt, non-payment, damage, breach of representations and warranties, non-provision of after sales or warranty services or fraud as regards the products or services in Biandsokart You have specifically authorized Biandso or its service providers to collect, process, facilitate and remit payments or the Transaction Price electronically or through Cash on Delivery to and from other Users in respect of transactions through Payment Facility. Your relationship with company, is on a principal to principal basis and by accepting these terms of use, agree that Biandso krt is an independent contractor for all purposes, and does not have control of or liability for the products or services that are listed on the Platform, that are paid for by using the Payment Facility. WKS e-Shoppe does not guarantee the identity of any User nor does it ensure that a Buyer or a Seller will complete a transaction. You understand, accept and agree that the payment facility provided by Biandsokart  is neither a banking nor financial service but is merely a facilitator providing an electronic, automated online electronic payment, receiving payment through Cash On Delivery, collection and remittance facility for the Transactions on the biabdso  Platform, using the existing authorized banking infrastructure and Credit Card payment gateway networks. Further, by providing Payment Facility.

Buyer’s facility:

A buyer purchase products and services from the seller, using payment facility, and the buyer pay, transaction price through bank to the Seller using payment facility. A buyer may agree with the seller through electronic communication and electronic records and using the automated features they provided. Payment on any extension to increase the dispatch and delivery time and the transaction shall stand amended. A buyer shall be entitled to claim a refund of the transaction Price, in case you do not receive the delivery within the time period agreed in the transaction or within the time period as provided in the policies.. In case you do not raise a refund claim using platform features within the stipulated time than this would make you ineligible for a refund. In delivery transactions, refunds, if any, will be made via electronic payment transfers. In cash on delivery transactions, buyer is not required to confirm the receipt of products or services. Except for cash on delivery transaction, refund, if any, shall be made at the same, issuing bank from where transaction price was received or through any other method available on the platform, as chosen by buyer. Refund shall be made in Indian rupees only and shall be equivalent to the transaction price received in Indian rupees. The seller may also request you for additional documents if any for verification. Bindsokart receives, Valid Credit or debit or cash card or any valid bank account and such other infrastructure or any other financial instrument directly or indirectly through payment aggregator or through any such facility authorized by Reserve bank of India, to provide enabling support facility for collection and remittance of payment or by an individual. Buyer during any time period, and reserves the right to refuse to process Transactions exceeding such limit. The buyer and seller acknowledge that Biandsokart will not be liable for any damages, interests or claims etc. resulting from not processing a transaction price or any delay in processing a transaction, because transaction is not in Biandso’s control.

Account suspension:

Biandsokart has the right to control its website and its policy and its functional activity and not allow to control by any one and also have the right to add or suspend any one, will be its sole decision. If any kind of abuse words find on the review contains of the buyers found offensive and Biandso shall have the right to delete the customer review. Biandsokart have the right to put them blacklist, the customer from posting any further customer reviews.

Jurisdictional issue:

Unless otherwise specified, the material on the Platform is presented solely for the purpose of sale in India. Biandso make no representation that materials in the Platform are appropriate or available for use in other locations or Countries other than India. Those who choose to access this site from other Countries other than India do so on their own initiative and Biandsokart is not responsible for supply of products, refund for the products, ordered from other locations/Countries other than India, compliance with local laws, if and to the extent local laws are applicable.

Disputes (Resolutions) Policy:

There are many reason to become dispute or issue between both seller and the buyer. Generally, transactions are conducted smoothly on Biandsokart However there may be some cases where both the Buyers and Sellers. It means, a disagreement between a Buyer and a Seller in connection with a transaction on the Platform. So Biandso has a Dispute Resolution process in order to resolve disputes between Buyers and Sellers. Disputes arise out of an issue that is raised by either party not being completely satisfied with the resolution of their complaint or issue. But it is very impotent to solve the dispute before raises a dispute. Whenever a Buyer raises a dispute, the Seller's payment for that order is put on hold immediately until the issue is resolved.

Various Types of ‘Disputes’?

There are a lot of disputes. Some of them are wrong item received, Item that wrongly described Damaged and broken on Product, Accessory found missing, wrong specification. and not functional etc. In case the Seller rejects the return request of the Buyer, and Buyer raises a dispute, then Biandso will try to mediate and resolve the dispute between both the parties. If the dispute is resolved in favor of the Buyer, a refund is provided once the product is returned to the Seller. If the dispute is settled in favor of the Seller, Buyer is entitled to any refund.

Buyer protection program:

In case of a dispute where the Seller is unable to provide a refund or a replacement, will actively work towards reaching a resolution. The Buyer Protection Program covers Buyers who are unable to successfully resolve their dispute with the Seller or are not satisfied the resolution provided by the Seller. Both the buyer and the seller contact each other to solve the issue. If the issue is not resolved by the seller, Biandso Customer Support team will handle and solve the problem. Buyers means who have purchased product from Biansokart, are eligible for the Buyer Protection Program. They can file dispute within 45 days from the date of delivery of the product. Any damage or loss to the product after delivery will not be covered under this program and will completely be the Buyer's responsibility. Buyers should refuse to accept delivery if the item is damaged. Seller has agreed to replace the order without expecting the original shipment back Blacklisted and Blocked Buyers are not covered by the Buyer Protection Program. Biandsokart will not be responsible for any direct or indirect losses, expenses, costs of any nature whatsoever that may be incurred by any Buyer or Seller. Biandso does not provide any guarantee or warranty to Buyers for products sold on Biandso, against technical or manufacturing defects. Biandsokart Customer Support Team may seek additional information or clarification from Buyer to facilitate resolution of the dispute. In the event Buyer does not respond with information or clarification sought within 10 days, such dispute shall be auto-closed in favor of the Seller. Decisions taken byBiandso, under the Buyer Protection Program shall be final. Biandso reserves the right to modify or discontinue Buyer Protection Program without any prior notice.

Trademark and trade name and trademark copyright:

Company may be adopted proprietary trade names and trademarks. These marks are of great value to the Company and are supplied on permissive, nonexclusive and terminable license basis to Biandso’s e-commerce for use only in an expressly authorized manner, exclusively in relation to the distribution and marketing of Products by the Company. The terms using biandsokart, agree, not to advertise. The given services and the advertising or promotional materials made available to buyers, by the Company. They are not to use any written, printed, recorded or any other material in advertising, promoting or describing the products or services or the Company marketing program, or in any other manner, any material which has not been copyrighted and supplied by the Company, unless such material has been submitted to the Company and approved in writing by the Company before being disseminated, published or displayed, company materials printed or film, produced like sound recording, or the internet, are copyrighted and shall not be reproduced in whole or in part by Biandso buyers or any other person except as authorized by the Company. Permission to reproduce any materials will be considered only in extreme circumstances. Therefore, an Biandso buyer should not anticipate that approval will be granted, even if the same is sought by the Biandso buyers. They shall not produce, use or distribute any information relative to the contents, characteristics or properties of company product or service which has not been provided directly by the Company. This prohibition includes but is not limited to, print, audio or video. A buyer shall not produce, sell or distribute literature, films or sound recordings which are deceptively similar in nature to those produced, published and provided by the Company for its promotional activities. Biamdsokart Direct Seller purchase, sell or distribute non-company materials which imply or suggest that said materials originate from company or in any manner similar to the Products of the Company, in functionality, purpose, utility. Any display ads or institutional or trademark advertising copy, other than covered in the foregoing rules, must be submitted to the company and be approved in writing by the company prior to its publication. All advertising, direct mailing, and display, must be approved in writing before being disseminated, published or displayed. Advertising on radio, TV, newspapers, magazines, and websites except through the permitted website under is strictly prohibited. This site is controlled and operated byBiandso’ products are sold by respective Sellers. All material on this site, including images, illustrations, audio clips, and video clips, are protected by copyrights, trademarks, and other intellectual property rights. Material on Platform is solely for your personal, non-commercial use. The Company will not permit the use of its copyrights, designs, logos, trade names, trademarks, etc., without prior permission. A seller or a buyer will not use the Company logo as their sales materials, except upon approved business cards. The trademarked term or Trade Mark of the Products must also be appropriately annotated. In addition to general prohibitions on use of the Company trademarks or logos, the Company specifically prohibits the use of Company trademarks or logos in conjunction with the sale of any other non-Company products. You must not copy, reproduce, republish, upload, post, transmit or distribute such material in any way, including by email or other electronic means and whether directly or indirectly and you must not assist any other person to do so. Without the prior written consent of the owner, modification of the materials, use of the materials on any other Platform or networked computer environment or use of the materials for any purpose other than personal, non-commercial use is a violation of the copyrights, trademarks and other proprietary rights, and is prohibited. Any use for which you receive any remuneration, whether in money or otherwise, is a commercial use for the purposes of this clause.

Limitation of liability:

Biandsokart digital marketing will not be liable or responsible in any way for any User Content posted on or linked from a website, including, but not limited to, any errors or omissions in Content, or for any losses or damage of any kind incurred as a result of the use of or reliance on any Content or other material accessed on or through Website and made available by a third party. Companies Liability whether under contract or otherwise, arising out of or in connection with this contract shall not exceed the less of actual damages or loss accessed by the arbitrator. wks is liable for any special, incidental, indirect or consequential damages of any kind in connection with these terms of use, even if user has been informed in advance of the possibility of such damages.

Warranty and Guarantee:

Biandsokart does not provide any warranty or guarantee and refund or replacement or return or exchange, whatsoever nature of its products. No claims shall be entertained by wks, with respect to the above mentioned policies. All the guarantee and warrantee or exchange and return is provided by the sellers, who is the real makers of the product.

Product delivery:

The main delivery system is courier like services for online purchase, accepting our website policy. If you do not agree or accept our shipping policy, you may purchase our products in offline manner, from our authorized pick-up center, after product inspection, you shall accept the product and thereafter make the payment to us with the bank details as provided by us. Once you accept the delivery from our authorized pick-up center or from the company, there is no defect in the product and that you have accepted the delivery. In case, if there is no authorized pick-up center near you, wait until for a new pick-up center, is launched in your area.

Buyer's arrangement with issuing bank:

All valid credit card, debit card, cash Card and other payment instruments are processed using a Credit card payment gateway or appropriate payment system infrastructure and the same will also be governed by the terms and conditions agreed to between the Buyer and the respective Issuing Bank and payment instrument issuing company. All Online Bank Transfers from Valid Bank Accounts are processed using the payment gateway, provided by the respective Issuing Bank which support Payment Facility to provide these services to the Users. All such Online Bank Transfers on Payment Facility are also governed by the terms and conditions agreed to between Buyer and the respective Issuing Bank.

Replacement guarantee:

Biandsokart Replacement Guarantee permited, if any defect is found in the product/s can ask for replacement of the product from the seller and it may be subject to the its terms and conditions. Damaged or defective products are not covered under the manufacturer's warranty. Any product that is returned without all original packaging and accessories, including the box, manufacturer's packaging if any, and all other items originally included with the product delivered. Clothes and footwear are not used altered, washed, soiled or damaged in any way. Original tags and packaging should be intact. For items that come in branded packaging, the box should be undamaged. Returns are not applicable in jewelry, Innerwear, lingerie, socks, clothing freebies, etc. Any buyers and sellers are involved in any wrong, activity or not genuine, wks reserving its rights to initiate civil and criminal proceedings against such member buyers and sellers to discretion, suspend, block, restrict, cancel the Display Name of such buyers and sellers or disqualify that user and any related users from availing protection through this program. Any person who committed guilty or a criminal offence will be prosecuted to the fullest extent of the law. Such customers will be blocked for fraudulent activity; Biandsokart will not be allowed to return their products.

Jurisdiction & Governing Law:

Any dispute arising out of this Agreement or in any manner touching upon it, the same shall be settled through arbitration under Arbitration and Conciliation Act 1996, with all statutory amendments, by a sole arbitrator to be appointed by a Director of the Company, who may be specifically authorized by the Board of Directors of the Company. The venue of arbitration shall be at kannyakumari district, in Tamilnadu. These rules are reasonably related to the laws of the India and shall be governed in all respects thereby. The parties agree the courts at kannyakumari, alone shall have exclusive jurisdiction. In case the Company shifts its registered office from City of Kannyakumari to any other city, in a different State, the courts at that city, where the registered office of the Company is situated alone shall have exclusive jurisdiction.

Cancellation penalty:

In order to maintain a good customer experience for customers, it is important for you to ensure that the products you have listed on Biansokart, are in stock and available to ship. However, we understand that there could be delays that are out of your control leading to late dispatch or order cancellation. In that case, Biandsokart will not charge any penalty for this.

Dispute settlement:

Any dispute arising out of this agreement or in any manner touching upon it, the same shall be settled through arbitration under Arbitration and Conciliation Act 1996 with all statutory amendments, by a sole arbitrator to be appointed by a Director of the Company, who may be specifically authorized by the Board of Directors of the Company in this regard. The venue of arbitrator shall be in Chennai.

Applicable Law:

Terms of Use shall be governed by and interpreted and construed in accordance with the laws of India. The place of jurisdiction shall be in Chennai

Formal resolution:

If the company is unable to settle the matter informally and if the appropriate corrective action is deemed by the company to be taken other than termination or the company will forward a decision letter to the violating store owner. The decision letter will list the specific complaint(s), outline the corrective action to be taken and, if appropriate, setting a time limit for compliance. The Company reserves the right, at its sole and entire discretion, to terminate store ownership at any time if the Company determines. More resolutions will add time to time, when ever needy.

Applicable Act:

Buyer and Seller shall comply with all the applicable laws (including without limitation Foreign Exchange Management Act, 1999 and the rules made and notifications issued there under and the Exchange Control Manual as may be issued by Reserve Bank of India from time to time, Customs Act, Information and Technology Act, 2000 as amended by the Information Technology (Amendment) Act 2008, 2009, Prevention of Money Laundering Act, 2002 and the rules made there under, Foreign Contribution Regulation Act, 1976 and the rules made there under, Income Tax Act, 1961 and the rules made there under, Export Import Policy of government of India) applicable to them respectively for using Payment Facility and of Biandsokart Platform.

Grievance:

In accordance with Information technology Act and e-commerce rules made there under and the consumer protection act.Biandsokart doing a public related business oriented platform. There is a chance to create a lot of different kinds of Buyers, may get in to the business. So, here is a chance to develop a lot of complaints. Our buyers have, if any such complained, the company will take action against your complaints. Therefore, If you have any complaints, please sent ii directly to us on the email. Company will find a suitable remedy and infirm you within a short time

Employee relation:

A customer or a store owner who committed which us, to purchase or sales process, will not be an employee ofBiandso. Nothing in this agreement shall establish either an employment Relationship or any other labor relationship between parties or other representative of the Company.

Modification Right:

Company reserve the right to alter, modify or amend product prices, policies and procedure, product availability and marketing strategy , agreement and notices. A seller or a buyer disagree these terms, they may terminate from their contract with immediate effect after giving a written notice from the Company.

Any notice and other communications provided for shall be in writing and shall be sent with prepaid registered post with acknowledgement due or speed post, at the registered address as provided in contact us section of this website.
